Terms of Service

Effective May 18, 2026.

These Terms of Service ("Terms") form a binding agreement between Novus Technologies Pte Ltd ("Novus Technologies", "we") and the individual or entity using the platform ("Customer", "you"). By creating an account or using the service, you accept these Terms.

1. Agreement

If you sign up on behalf of a business, you confirm you are authorised to bind that business. Your use is also subject to our Privacy Policy and any plan-specific addendum.

2. The service

Novus Technologies is a self-serve automation studio that helps Customers send templated communications across WhatsApp, SMS, email, and (on certain plans) voice. The service is provided as-is and is improved continuously. We may add, remove, or change features after reasonable notice.

3. Accounts & workspaces

  • You are responsible for keeping login credentials secret and notifying us of any compromise.
  • One workspace is a separate tenancy. All data, settings, and billing are workspace-scoped.
  • You may invite teammates and assign roles. You're responsible for what they do.
  • You must be at least 17 years old and not on any sanctions list.

4. Acceptable use

You agree NOT to use the service to:

  • Send unsolicited bulk messages, spam, or content that violates Indonesian law including UU ITE.
  • Send phishing, scam, or fraudulent messages.
  • Distribute malware, ransomware, or illegal content.
  • Impersonate another person or organisation.
  • Reverse-engineer or attempt to bypass workspace isolation, rate limits, or billing.
  • Use the service for political campaigning without prior written consent and clear sender identification.

We may suspend or terminate accounts that violate this section, with or without notice, depending on severity. Where third-party channel providers (WhatsApp, SMS operators) suspend your traffic, those suspensions apply automatically.

You confirm you have a lawful basis (consent, contract, or legitimate interest) to message each contact you upload. You are the controller of your contact list. Consent flags in Novus Technologies help you record this — they do not replace your duty to obtain consent.

6. Fees & billing

  • Prices are in Indonesian Rupiah (IDR), inclusive of applicable PPN.
  • Paid plans renew automatically until cancelled.
  • Channel pass-through costs (e.g. WhatsApp conversation fees, SMS termination) are billed at cost on top of plan fees and shown on your usage page.
  • Annual plans save 20% versus monthly; switching is allowed at any renewal.
  • 10-day money-back guarantee: if you are not satisfied within 10 calendar days of a paid plan starting, request a refund and we will return your most recent plan payment in full. The guarantee applies to Starter, Growth, Pro, and Enterprise.
  • Outside the 10-day guarantee window, refunds are provided pro rata where we materially fail to deliver an undisputed feature, at our discretion.

7. Customer data

You own your Customer Data. We process it as a data processor under our Privacy Policy. We will not access your data except (a) on your instruction, (b) to operate or secure the service, or (c) when legally required.

You can export all Customer Data as CSV / JSON at any time. On termination, we delete data per the retention schedule in the Privacy Policy.

8. Uptime & support

  • Target uptime: 99.9% for the API and queue layer, measured monthly excluding scheduled maintenance.
  • Free plan: best-effort community + docs.
  • Starter / Growth: email support, response within 1 business day (Asia/Jakarta).
  • Pro: priority support, response within 4 business hours; named success contact.
  • Enterprise: priority support and a named success contact, with deployment and SLA terms set in your contract; available self-hosted.

9. Intellectual property

We retain all rights to the platform, including templates we ship, the Novus Technologies name, and documentation. You grant us a limited licence to host and process your Customer Data solely to operate the service.

10. Warranty disclaimer

Except as expressly stated, the service is provided as-is and as-available. We do not warrant uninterrupted operation, error-free behaviour, or compatibility with every third-party system. Statutory rights you have as a consumer in Indonesia are not affected.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of these Terms is limited to fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or revenue-loss damages.

12. Termination

  • You may cancel at any time from Settings → Billing. Service continues until end of paid period.
  • We may suspend for non-payment, security risk, or material breach with 7 days' notice (immediate if abuse is severe).
  • After termination, data is retained per the Privacy Policy schedule.

13. Governing law

These Terms are governed by the laws of the Republic of Singapore. Disputes are resolved in the courts of Singapore, except where consumer protection law in your jurisdiction gives you the right to file elsewhere.
